A guide to demerit points in Quebec

In Quebec, you can receive demerit points on your driver’s licence if you’re convicted of a traffic offence. If you reach a certain threshold, your licence may be temporarily suspended or revoked. Having demerit points on your record can also be costly when you renew your licence.

In this article, we will take a detailed look at how demerit points work, how they are applied, how they affect your licence, and how they impact insurance.

The important points

  • In Quebec, demerit points are added to your driver’s licence when you’re convicted of a traffic offence, and they stay on your record for two years from the date of conviction.
  • A driver’s demerit point threshold is determined by their age and licence class; reaching it triggers a temporary suspension or revocation of your licence.
  • Demerit points accumulated over the past 2 years increase the cost of renewing a licence with the SAAQ; private insurers may also raise premiums based on the underlying convictions.

What are demerit points?

The Société de l’assurance automobile du Québec (SAAQ), the provincial body responsible for driver’s licences, administers demerit points. The SAAQ assesses penalties when drivers are convicted of violating the Highway Safety Code. The more serious the infraction, the more demerit points you receive. You can receive demerit points for offences ranging from minor speeding to distracted driving, and they remain on your driving record for two years.

Your maximum allowable point threshold depends on your age and licence type. Crossing your designated limit can result in an automatic licence suspension, higher insurance premiums, and significantly more expensive SAAQ renewal fees.

To have demerit points assessed against your record, you must be convicted of an offence. Demerit points do not apply to any traffic tickets assessed through photo radar, such as speeding or running a red light. These cameras record only the licence plate, and the ticket is issued to the vehicle owner regardless of who was driving at the time.1

How demerit points are applied

Demerit point thresholds

In Quebec, demerit points start at zero and are added to your driver’s licence. Demerit point thresholds vary by driver age and licence type. The threshold represents the cumulative score that triggers an automatic licence suspension. The points remain on your record for 2 years following the date of conviction.2

Driver category Age / Experience bracket Demerit point limit Warning letter sent
Learner’s licence Any age 4 points N/A (immediate suspension risk)
Probationary licence First 2 years of driving (any age) 4 points N/A (immediate suspension risk)
Unlicensed drivers Individuals who do not hold a permit 4 points Right to obtain a licence suspended
Full licence (class 5) Under 23 years old 8 points At 4 points
Full licence (class 5) Ages 23 to 24 12 points At 6 points
Full licence (class 5) Ages 25 and older 15 points At 7 points

Suspension timelines and reinstatement requirements

A driver loses their licence when their active demerit point total equals or exceeds their assigned bracket threshold. When this occurs, the SAAQ issues a notice of licence revocation. The notice indicates the number of demerit points assessed and how long they will remain on your record. The minimum revocation period is 3 months and can be as long as 6 or 12 months, depending on the applicable bracket, the number of points, and the duration of the most recent penalty imposed within the previous 2 years.

Depending on the length of revocation, the frequency of infractions, and the driver’s licence status, the reinstatement process may include fee payments, a knowledge re-test, and retaking the written/practical driving exam.2

Category Revocation duration Reinstatement requirements
First threshold breach 3 months minimum Pay reinstatement fees; potential knowledge re-test
Repeat infractions (within 2 Years) 6 to 12 months Retake written/practical driving exams; safety coursework
Unlicensed offenders 3 to 12 months suspension of right to obtain a licence Waiting period must elapse before eligibility for learner’s permit

If you hold a driver’s or probationary licence and this is your first revocation in 2 years, you can ask a judge for a restricted licence, provided that you can demonstrate that operating a motor vehicle is an essential requirement of your main employment.

If you are caught driving a vehicle while your licence is revoked or suspended, the vehicle you are driving will be seized and impounded for 30 days at the owner’s expense. You will also have to pay a $600 to $2,000 fine, plus legal and administrative fees.2

Transfer of demerit points between Quebec and Ontario

Under a reciprocal agreement established on April 1, 1989, Quebec and Ontario systematically exchange conviction data for traffic offences.3

If a Quebec driver in Ontario is convicted of a moving violation in Ontario, the Ontario Ministry of Transportation (MTO) notifies the SAAQ. The SAAQ enters the offence into your Quebec driving record and assesses demerit points according to Quebec’s points scale.

For an Ontario driver in Quebec, Quebec convictions are forwarded to the MTO, and Ontario applies its own equivalent demerit point scale to the driver’s Ontario licence.

Quebec also maintains active reciprocal agreements with New York and Maine.

Common infractions and point penalties

Several driving infractions can lead to demerit points being assessed against your licence. These generally belong to two categories: speeding and moving violations.

Demerit points for speeding

Speeding penalties escalate based on how much you exceed the posted limit. The following chart shows how many demerit points are assessed in a zone where the posted speed limit is 60 km/h or less:4

Speed over the limit Demerit points assessed
11 to 20 km/h 1 point
21 to 30 km/h 2 points
31 to 39 km/h 3 points
40 to 45 km/h 6 points
46 to 49 km/h 10 points
50 to 60 km/h 10 points
61 to 80 km/h 14 points
81 to 100 km/h 18 points
101 to 120 km/h 24 points
121 km/h or more 30 points or more

Moving violations

Moving violations include offences such as running a red light, using a cell phone while driving, and failing to stop for a school bus. The following chart shows how demerit points are assessed for some common moving violations.4

Infraction Demerit points
Tailgating (failing to keep a safe distance) 2 points
Failing to yield to oncoming traffic 2 points
Failing to wear a seat belt 3 points
Failing to obey a red traffic light or stop sign 3 points
Speeding or reckless driving 4 points
Driving while using a portable electronic device or a display screen 5 points
Failing to stop for a school bus 9 points
Driving for a wager or a stake in a race 12 points

How long do demerit points stay on your record?

Do demerit points go away?

Demerit points remain active on your driving record for exactly 2 years from the date of conviction (the date you pay the fine or the court enters a guilty finding), not the date the police officer issued the ticket. Once 24 full months have elapsed, those points automatically expire and no longer count toward a licence revocation.2

Quebec does not offer voluntary driving courses or administrative fees to wipe out points early; you must wait for the 2-year period to expire before the points are removed from your record.

Demerit points can have financial implications through public licence fees and private auto insurance.

SAAQ licence renewal fee

Quebec’s public insurance plan covers bodily injuries. The annual insurance contribution component of your driver’s licence fee scales with the number of active demerit points on your record. This fee is evaluated on points accumulated over the past 2 years. The following chart shows licence renewal costs for class 1 to 5 drivers.5

Demerit points Insurance contribution (tax included) Charge Fees paid to the Ministère des Finances Total
0 $23.48 $5.45 $21.30 $50.23
1 to 3 $101.04 $5.45 $21.30 $127.79
4 to 6 $179.27 $5.45 $21.30 $206.02
7 to 9 $245.17 $5.45 $21.30 $271.92
10 to 14 $340.69 $5.45 $21.30 $367.44
15 or more $582.21 $5.45 $21.30 $608.96

Auto insurance

Private car insurance covers vehicle damage and civil liability. Insurers don’t calculate premiums solely from your point total; they rate your policy based on your infraction and conviction history over the past 3 years. A careless-driving or excessive-speeding conviction can lead to substantial car insurance premium increases.

“When you apply for or renew private auto insurance, the underwriter will examine your driver’s abstract,” said Daniel Mirkovic, President + CEO of Square One. “More specifically, they will evaluate the number, frequency, and severity of your traffic tickets. While a minor speeding ticket may have little impact, an insurer will consider a driver with multiple infractions or a major offence like distracted driving or excessive speeding as a high risk.”

Commonly asked questions

How do I check how many demerit points I have?

You can check your demerit points online through the official SAAQ portal (SAAQclic). After logging in, go to the Driving Record section to review your points and infractions. You can also call a SAAQ customer service line or visit a local service centre. You will be asked to provide your driver’s licence number and primary identification to obtain an official copy of your driving record.6

How many points does a newly licenced driver receive?

A newly licensed driver starts with 0 points. Drivers can only be assessed demerit points if they are convicted of a traffic violation.

Can somebody drive with 3 demerit points on their record?

Receiving demerit points doesn’t necessarily mean your licence will be suspended or revoked. However, drivers with a probationary or learner’s licence need to be careful if they reach 3 demerit points, since the suspension threshold for this licence category is 4 demerit points.7
